On Monday, a Claiborne County judge approved a motion to dismiss the case against Morris Bevily, who faced charges of murder over the death of his daughter.

Bevily and his wife, T’Kia, were indicted for capital murder in the death of his 14-month-old daughter Jurayah Smith.

Last year, T’Kia was found guilty of capital murder and sentenced to life without the possibility of parole.  However, the conviction was later overturned when it was revealed that one of the jurors in the trial was the victim’s great uncle.

Last month, T’Kia was found not guilty by a jury in Monroe County.

Assistant District Attorney Patrick E. Beasley filed the motion to dismiss, citing the state had insufficient evidence to prosecute.
