There is no longer an effort in the legislation to provide its version of the medical marijuana bill.

The target date for Initiative 65 to be in effect with established production, regulation and licensing structures is August 15, 2021. Regulations for all aspects of the program have a deadline to be in place by July 1, 2021.

Lawmakers were trying to come up with their own version of the bill, which sought to add language to the existing Harper Grace’s Law. Lawmakers chose to kill the Senate’s proposal and the existing law remains in place.

Without legislation, the only thing left is Initiative 65, which is currently pending a lawsuit set to be heard in mid-April. Madison Mayor Mary Hawkins Butler is challenging the initiative, arguing the process is flawed and the measure was presented improperly before voters.

The Mississippi Supreme Court is reviewing the validity of the referendum, which states Initiative 65 was placed on the ballot unlawfully.

The future of the medical marijuana program now seems to rest with the state’s Supreme Court.
