BOS sends letter to contractor as patience runs thin

County Attorney Blake Teller addressed the Board and explained he’d drafted a letter from the county addressed to Phoenix Fabrications demanding the company make good on completing the water tank at the site of Warren County’s new jail.

According to reports, the contracted company has had delays and issues building the tank. The latest development was the concrete slab laid to support the tank was laid incorrectly. The fabricators will now need take the slab out and restart the process.

Teller explained the county was also notifying the Performance Bond and if the county needs to move to a different company, a claim can be made on the bond for the money coming from taxpayers. Also, each day the contractors are late on services the county is deducting delay damages from the overall payment to Phoenix Fabricators.

“Our price keeps going down everyday, but we’d prefer to have the product,” said Teller. “”We would hope this serves as an incentive for them to get the job finished.”

District 1 Supervisor Ed Herring expresses his aggravation with the project.

“I’m sure everyone in here feels the frustration. I hope the letter emphasizes our frustration. Because we made the decision not to move forward with another company, because they assured us the only path forward was because they had their base and everything in place. Now to find out, the 11th hour, your base was incorrect, the whole time. 
I know I sent an email over, and I try to keep things professional. But their actions are very unprofessional. And now it’s always a delay on top of a delay on top of more delays. I don’t know if they’re not hearing us?” said Herring.

Teller said a group of engineers helped prepare questions for Phoenix Fabricators which are included in the letter.

Phoenix Fabricators have until Friday, June 26, at 5 p.m. to respond to the county’s letter.
